Terms of Service

These Terms of Service ("Terms") govern your use of the TinyBridge Choice Boards application (the "Service") operated by TinyBridge ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you:

• Are at least 18 years of age, or are a minor with parental/guardian consent
• Have the legal capacity to enter into these Terms
• Agree to comply with all applicable laws and regulations

If you are using the Service on behalf of an organization (school, clinic, care facility), you represent that you have authority to bind that organization to these Terms.

2. Description of Service

TinyBridge Choice Boards is a communication tool that:

• Converts photos into interactive choice grids for non-verbal communication
• Uses artificial intelligence to detect items in photos and generate tile images
• Provides text-to-speech playback when choices are selected
• Syncs boards across devices with offline-first capability
• Stores boards and user data securely in the cloud

3. Accounts and Authentication

• You must sign in with a Google account to use the Service
• You are responsible for maintaining the security of your Google account
• You are responsible for all activity under your account
• You must notify us immediately of any unauthorized use of your account
• One account is intended for one caregiver/user; do not share login credentials

4. User Content

4.1 Your Content

You retain ownership of all content you create or upload through the Service, including photos, board configurations, and choice items ("User Content"). By using the Service, you grant us a limited license to:

• Store, process, and display your User Content to provide the Service
• Send your photos to AI services (OpenAI, Google Gemini) for item detection and image generation
• Cache generated images to improve performance

This license terminates when you delete your content or account.

4.2 Content Restrictions

You agree not to upload or create content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Contains explicit, violent, or inappropriate material
• Infringes on intellectual property rights of others
• Contains malware, viruses, or harmful code
• Violates the privacy of others without their consent

4.3 Photos

You represent that you have the right to capture and upload any photos you submit to the Service. You are responsible for obtaining any necessary permissions from individuals depicted in photos or from property owners.

5. Acceptable Use

You agree to use the Service in accordance with our Acceptable Use Policy. In summary, you must not:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or other users' data
• Interfere with or disrupt the Service infrastructure
• Use the Service to harass, harm, or exploit any person
• Reverse-engineer, decompile, or disassemble the Service
• Use automated tools to scrape or extract data from the Service

6. AI-Powered Features

The Service uses artificial intelligence for photo analysis and image generation. You acknowledge that:

• AI-generated results may not always be accurate or appropriate
• You should review AI-detected items before presenting boards to users
• AI-generated images are approximations and may not perfectly represent items
• We are not responsible for AI misidentifications or inappropriate outputs
• Photos are sent to third-party AI providers (OpenAI, Google) for processing

7. Intellectual Property

• The Service, its design, code, and branding are owned by TinyBridge and protected by intellectual property laws
• The TinyBridge name, logo, and related marks are our trademarks
• You may not copy, modify, or distribute the Service or its components without our permission
• AI-generated images created through the Service are provided for your personal use within the app

8. Availability and Modifications

• We strive to maintain Service availability but do not guarantee uninterrupted access
• We may modify, suspend, or discontinue the Service (or any part) at any time
• We will make reasonable efforts to notify you of significant changes
• The offline-first design allows continued use of previously synced boards even without internet

9. Disclaimers

• We do not warrant that the Service will be error-free, secure, or uninterrupted
• We do not warrant the accuracy of AI-generated content
• The Service is a communication aid, not a medical device. It is not intended to diagnose, treat, cure, or prevent any condition
• We do not provide medical, therapeutic, or educational advice through the Service
• Always consult qualified professionals (speech-language pathologists, therapists, educators) for communication therapy decisions

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• TinyBridge shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or $100, whichever is greater)
• We are not liable for losses caused by AI misidentifications, service interruptions, data loss (beyond our reasonable control), or third-party service failures

Some jurisdictions do not allow limitation of liability for certain types of damages. In such cases, our liability is limited to the minimum extent permitted by law.

11. Indemnification

You agree to indemnify and hold TinyBridge harmless from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

• You may stop using the Service and request account deletion at any time by contacting info@tinybridge.ai
• We may suspend or terminate your access if you violate these Terms
• Upon termination, your right to use the Service ceases immediately
• We will delete your data in accordance with our Privacy Policy and applicable data retention obligations

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which TinyBridge is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the app or by email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and TinyBridge regarding the Service.
